Cambodia Legal Update: Ministry of Land Management, Urban Planning and Construction Issues New Instruction on Strengthening Quality and Safety of Buildings

On 10 January 2020, the Minister of the MLMUPC issued Instruction No. 002 on Strengthening the Quality and Safety of Buildings (“Instruction No. 002”).

Instruction No. 002 prohibits the performance of construction or demolition work without first having obtained the required permits, licenses and authorizations and states that buildings cannot be occupied and/or used if an occupancy certificate or a construction site closing permit has not been obtained in advance.

Instruction No. 002 also stipulates that (i) worksites must have a duly licensed engineer present at all times to supervise construction work being carried out and that (ii) it is prohibited to reside, even temporarily, within a building that is under construction.

Instruction No. 002 places particular emphasis on verifying permits in order to ensure that they are approved in accordance with the design documents that have been assessed and signed by a duly licensed blueprint design company.

The new Instruction provides further guidance on what MLMUPC officials should look for on construction sites along with the circumstances and times in which they may conduct construction or building site inspections.
