DFDL Cambodia Organizes Seminar on Capital Gains Tax & Its Impacts on the Cambodian Real Estate Sector

On 30 September 2020, DFDL Cambodia in collaboration with CBRE Cambodia, hosted a hotly anticipated seminar on ‘Capital Gains Tax & its impacts on the Cambodian Real Estate Sector’ in Phnom Penh which attracted wide interest from the business community, NGOs, real estate players and other affected stakeholders resulting in a well-attended and successful event.

Capital gains tax is set to be implemented from 1 January 2021 onward. Cambodia tax resident Individuals and offshore investors in various sectors, particularly real estate will be significantly affected by this new tax and its related reporting obligations. DFDL’s latest event aimed to clarify the main issues and uncertainty surrounding the new CGT rules, in particular how they will apply in practice to the real estate sector in Cambodia and whether they may discourage or enhance investment in this key area.

With James Hodge (CBRE Cambodia Senior Director) serving as the event’s moderator, Clint O’Connell (DFDL Cambodia Partner, Deputy Managing Director & Head of Tax Practice) gave a general overview of CGT in Cambodia, how it is calculated and the various trigger points for when it becomes payable among other factors. His presentation was followed by an insightful discussion on the impact of capital gains tax on the real estate sector delivered by Charles Amar (DFDL Cambodia Head of Real Estate Practice). After a brief coffee break and networking session, Sothida Ann (CBRE Cambodia Managing Director) concluded the presentations with a regional market overview to give a more rounded understanding of the future of Cambodian real estate in light of the upcoming law and how this compares to similar developments being pursued in other jurisdictions.

       

The seminar concluded with a lively and active panel discussion with plenty of back and forth exchanges on the pros and cons of the new rules followed by a Q&A session with pointed and interesting questions from some of the 140+ attendees present.
