The Newly Enacted Cambodia Competition Law | 6 December 2021

DFDL Cambodia Co-hosts New Competition Law Webinar

On 6 December 2021, DFDL Cambodia, joined by the Consumer Protection Competition and Fraud Repression Directorate-General (“CCF”) and EuroCham Cambodia, organized a two-hour long webinar on Cambodia’s new Competition Law.

This session aimed to brief attendees on the new law, the major changes it ushers in and affects it will have on private enterprises, the nature of its intended implementation and underlying framework.

The event kicked off with a welcome note from Denis Sainte-Marie (Executive Director, EuroCham Cambodia) followed by opening remarks from H.E Phan Oun (Director-General of the Consumer Protection Competition and Fraud Repression Directorate-General under the Ministry of Commerce) where he outlined the historical genesis of the law.

The first presentation focused on the provisions of the law and its anticipated mode of enforcement given by Meng Songkheang (Director of the Competition Department, Consumer Protection Competition and Fraud Repression Directorate-General under the Ministry of Commerce).

Our expert, David Fruitman (Regional Competition Counsel/Senior Consultant), spoke on the underlying competition issues that businesses should consider. David explained the scope of the law and what businesses need to take into due consideration to ensure compliance with its provisions.

The session ended with a lively and engaging Q&A session moderated by Noë Schellinck (Advocacy Manager, EuroCham Cambodia) and with H.E Phan Oun, David Fruitman, Matthew Tippets (Chairman, EuroCham Cambodia ICT Committee, CEO & Co-founder, Clik,) and Chenevier Etienne (Partner & Director Asia at Citystar Group, Independent Director at ABA Bank, and Director at Asia Gourmet (Cambodia) Co., Ltd.) as panelists.

More than 150 attendees had a chance to have their queries answered by these experts. The event ended with some closing remarks from DFDL Partner, Chris Robinson.

Cambodia’s long-awaited Competition Law was signed into law by the King on 5 October 2021. While the Law has been enacted, the principal regulator, the Cambodia Competition Commission, has not yet been appointed and it is not clear how the Law will be enforced prior to a) such appointment and b) the issuance of required regulatory instruments and decisions.

The new law has raised many notable concerns and questions. In this webinar, the team of experts will go through the main points of the Law, its implementing regulations, and how its practical enforcement is expected to look like.
