DELEGATION OF AUTHORITY TO ISSUE RESIDENTIAL CONSTRUCTION PERMITS TO DISTRICT/MUNICIPALITY/KHAN ADMINISTRATION, Letter № 1472 of the Ministry of Interior (“MOI”), dated 16 August 2018.
In response to demands from local communities for residential construction and the more effective provision of administrative services in regard to construction, the Ministry of Land Management, Urban Planning, Construction and Cadastre (“MLMUPC”) has requested the MOI to authorize all municipal/provincial administrations to delegate the authority to issue construction permits for residences with no more than 4 stories (E0, E1, E2, E3) and a total area of no more than 500 square meters to district/municipality/khan administrations. The request was approved by the MOI through Letter № 1472, dated 16 August 2018, which authorized all municipal and provincial governors to delegate such authority to their respective district/municipality/khan administrations by the end of August 2018.
INSTRUCTION OF THE MINISTRY OF LAND MANAGEMENT, URBAN PLANNING AND CADASTRE (“MLMUPC”) TO MUNICIPAL/PROVINCIAL DEPARTMENTS OF LAND MANAGEMENT, URBAN PLANNING, CONSTRUCTION AND CADASTRE IN RESPECT OF REGISTRATION AND ISSUING OF CERTIFICATES OF IMMOVEABLE PROPERTY OWNERSHIP, Letter № 2017 of MLMUPC, dated 20 August 2018.
Now, the MLMUPC would like to instruct the municipal/provincial departments of land management, urban planning, construction and cadastre to:
(i) From 1 January 2019 (for initial sporadic registrations), issue Certificates of Immoveable Property Ownership instead of Certificates of Immoveable Property Possession using the new template as prescribed by Prakas № 089, dated 21 May 2018; and
(ii) Instruct the district/municipality/khan land offices to cooperate with the relevant authorities in conducting surveys and developing public infrastructure plans for examination and discussion with the departments, and request the relevant approvals from the municipal/provincial governors.
