The Impact of the New Regulation on the Registration of Hypothecs (21 October 2013, Cambodia)

Over coffee and croissants, Patrick Smith, Deputy Head of the Banking & Finance Practice Group, and Seka Hep, Senior Adviser to the Real Estate Practice Group, will present key elements of the new Prakas concerning the real rights registration procedure pertaining to the Civil Code. 


The main goal of this seminar is to explain the impact that the Prakas is expected to have on financial transactions.

Key discussion topics will include: 

  • Changes in the security registration procedures: new forms and new transaction documents; 
  • The framework for the implementation of multiple hypothecs with different priority; 
  • Impact of the new Prakas on existing transactions; 
  • Amending loan documents and security registrations: the issue of the secured amount reflected in security registrations;  
  • Expected changes in the practices of the land offices; and 
  • Other rights affected by the new Prakas: perpetual leases, usufructs, easements, statutory liens, pledges and hypothecs.
